Mercosur Safeguard Rules Let EU Curb Surges In Car And Goods Imports

Luxembourg: The Mercosur safeguard rules for industrial goods and cars now sit in EU law through Commission Delegated Regulation (EU) 2026/1741 of 15 July 2026, which a legal digest dated 3 November 2026 reports as published in the Official Journal. The act writes Chapter 9 and Annex 9-A of the EU-Mercosur Interim Trade Agreement into the Annex of Regulation (EU) 2019/287, so the agreement’s own terms take precedence over the general framework.

The Commission says the text adds no new rules and exists “to ensure transparency and readability,” according to the Lovguiden legal digest. It takes effect on the third day after publication and applies directly in every member state. The digest does not give the exact publication date, so readers should check the EUR-Lex text.

For most goods, the Mercosur safeguard rules allow measures when preferential imports rise so much, in absolute terms or against EU production or consumption, that they cause or threaten serious injury to a European industry. The Commission must show a causal link on objective evidence and must not blame Mercosur for injury that other countries cause. Producers behind more than 50 percent of EU output, or at least 25 percent in exceptional cases, represent the domestic industry.

Procedure under the Mercosur safeguard rules sets tight limits. An investigation runs up to one year, or 18 months in exceptional circumstances, and the Commission cannot impose measures if it misses the deadline. It must give Mercosur at least 30 days’ notice before a definitive measure and hold consultations. Authorities can extend a measure once, for no longer than the original period, and can use it only within a 12-year transition period, or 18 years for goods whose tariffs fall over ten years or more.

Cars face a lower bar under the Mercosur safeguard rules. For vehicles under HS codes 8703 and 8704, “injury” rather than “serious injury” is enough to justify action. A car measure lasts three years at most, one extension of up to two years is possible, and provisional measures cannot exceed 270 days. If the Commission acts, it must also set a tariff-preference quota that stays at or above average imports in the 36 months before the last 12 months of the data period, and the text rules out trade compensation.

The Mercosur safeguard rules give outermost regions their own clause. Under Article 9.20 of the agreement, the EU can impose measures that apply only in places such as Mayotte, Réunion, Madeira and the Canary Islands. That step requires a serious deterioration of the local economy and no mutually satisfactory solution with Mercosur.

The wider deal remains unsettled. Leaders signed it on 17 January 2026 in Paraguay, and the Interim Trade Agreement has applied provisionally since 1 May 2026. On 21 January Parliament voted 334 to 324, with 11 abstentions, to ask the Court of Justice for an opinion, and Parliament says that step suspends its own ratification for 16 to 18 months, according to its legislative train page, last updated on 25 October 2026.

Several questions stay open. The digest does not say whether any investigation has started or which body would adopt a specific measure. Farmers, carmakers and exporters will now watch whether the Mercosur safeguard rules work as a credible brake or as a rarely used promise, and the first case will show which.
