Defence Omnibus Wins Final Council Approval With 102 Day Permit Cap

Toulouse: The defence omnibus cleared its last hurdle on 9 October 2026, when the Council gave final approval to two regulations and one directive that speed up defence procurement, permits and transfers across the Union. The defence omnibus is the fifth of twelve simplification packages the Commission has proposed since February 2025. Parliament and Council negotiators struck a provisional deal on it on 10 June 2026, and Parliament adopted the package on 16 September.

The sharpest change concerns permits. Authorities must now decide on permits for defence projects within 102 working days, and a request that receives no answer in time is treated as tacitly approved. National law may still depart from tacit approval where there is a grave risk to human health or national security. Renew Europe has cited a shorter deadline of 42 working days with a single national contact point, and the Council’s announcement does not explain the gap between the two figures.

Procurement rules change as well. The package raises the thresholds in the defence procurement directive, and Renew Europe says the threshold for lighter rules is quadrupled. It also introduces occasional joint procurement, a de minimis rule for contract modifications and more flexible framework agreements, which should let buyers adjust a contract without restarting a tender.

Transfers of defence goods between member states become easier too. The text creates two mandatory general licences, one for transfers between certified suppliers and recipients and one for transfers inside an intra-EU industrial partnership. The European Defence Fund gets lighter management and application requirements and a higher funding-rate bonus for small firms, while the European Defence Agency can keep acting as a central purchasing body.

The defence omnibus reaches into environmental law as well. EU chemicals and environmental rules are amended so that exemptions become possible for chemical use linked to defence readiness. The Council says a high level of health and environmental protection remains the aim, so campaigners will watch how national authorities use the new exemptions.

Industry groups have long argued that slow permits and fragmented procurement hold back European production, and ministers have framed the package as part of a wider push to rebuild defence capacity. The speed with which national administrations adapt their permitting offices will matter as much as the legal text, because the defence omnibus only helps if the clock starts on time.

The acts will be published in the Official Journal and enter into force on the 20th day after publication. The Council has not said what the changes to the Defence Fund will cost. Manufacturers around Toulouse and other defence hubs will now test whether the 102-day clock and the new licences deliver faster contracts, and the defence omnibus will be judged on how quickly it turns shorter paperwork into deliveries during 2027.
