Düsseldorf: The packaging rules that now govern every product sold in the single market started applying on 12 August 2026, and compliance officers spent the weeks since discovering how much of the regulation still has no interpretation attached to it.
The Packaging and Packaging Waste Regulation entered force in February 2025 with an eighteen-month runway. Firms used it. What they could not do was write the implementing acts and harmonised standards that translate the regulation’s obligations into testable requirements, and the Commission has not finished issuing them.
Three obligations bind right now. Producers must register with extended producer responsibility schemes in each member state where they place packaging on the market. Every packaging type needs an EU declaration of conformity. Food contact packaging must meet restrictions on intentionally added PFAS above defined thresholds.
The PFAS restriction generates the most immediate difficulty because the analytical methods lag the legal limit. A converter can commit on paper that it added no fluorinated substances. Demonstrating that a coated paper cup falls below a total fluorine threshold requires laboratory capacity that does not exist at the volume the market needs, and accredited labs across Germany and Italy quote waiting times measured in months.
Registration produces a different friction. A mid-sized exporter selling into fifteen member states registers fifteen times, in fifteen languages, under fifteen national schemes with different fee structures and reporting calendars. The regulation harmonised the obligation and left the administration national, which is the pattern that made the old directive unworkable.
Industry bodies flagged both problems well before the date. The packaging federation warned in the run-up that firms would face obligations without the technical documents needed to meet them. Enforcement authorities in most member states have signalled a pragmatic first year, which helps the careful and rewards the indifferent.
The heavier requirements arrive later and depend on the same missing standards. Recycled content minimums for plastic packaging apply from 2030. Recyclability performance grades start in 2028 and determine EPR fee modulation, so a producer needs to know today which grade its design will earn in order to justify tooling investment. The grading methodology remains in preparation.
The Commission circular economy portal lists the sequence clearly enough. What it cannot list is a date for each delegated act, and procurement teams need dates more than they need principles.
None of this argues the regulation was wrong. Europe generates roughly 190 kilograms of packaging waste per person each year and the figure rose for a decade under a directive that member states transposed twenty-seven different ways. A regulation fixes that. A regulation without its technical annexes simply moves the uncertainty somewhere new.
