Tax Domicile Of EU Officials Gets Fresh Clarity From The Court

Trier: The Court of Justice has clarified how the tax domicile of EU officials is determined, in a judgment delivered on 15 October 2026 in case C-275/25, known as Kolwager. The ruling speaks to a question that affects thousands of staff in the institutions and agencies: which country may tax their gifts, inheritances and property when they live abroad for work.

The Court announced the result in press release 148/2026. The full judgment was not available when this report was prepared, and the summary of the ruling on the tax domicile of EU officials is brief, so this account relies on that summary and on reporting about the earlier stages of the case. Readers who need the exact wording should consult the judgment itself once they have access to it.

According to a Bloomberg Tax report on the Advocate General’s opinion of 23 April 2026, the dispute began in Germany. The taxpayer, a bank employee, was originally domiciled in Austria and worked in Luxembourg. The person later set up a private residence in Germany and received a monetary gift from a relative. German tax authorities then imposed gift tax on the basis that the taxpayer was resident in Germany when the gift arrived.

The case sits at the meeting point of national tax law and the special status of EU staff. The Protocol on the Privileges and Immunities of the European Union gives officials and other servants of the Union a particular fiscal position, and Article 13 is the provision usually cited when a dispute concerns the tax domicile of EU officials and where they are deemed to keep it. National rules on residence, such as the German rules applied here, can pull in a different direction.

Why does the tax domicile of EU officials attract so much attention? Because a domicile label decides which tax administration may claim a share of a gift, an inheritance or the income from property. Staff who move between Brussels, Luxembourg and their home countries often keep ties to several places. Two states can then claim the same person, and the person can face two bills or none.

The Court’s decision on the tax domicile of EU officials gives national authorities and staff a clearer way to answer that question, and it should reduce the room for inconsistent treatment between member states. Tax advisers who work with EU institutions will study how far the judgment ties national concepts of residence to the Union’s own rules, and whether it limits the discretion of tax offices in cases like the German one.

For officials, the practical advice is to keep records. Employment contracts, proof of where a person lived when joining the service, and evidence of later moves will all matter in a dispute. The ruling on the tax domicile of EU officials does not remove those burdens, but it gives them a firmer legal frame, and national courts across the Union will now apply it.
