Wageningen: In this small Dutch town, whose university and surrounding research campuses have made it one of the densest concentrations of agricultural science on the planet, plant breeders are watching the European Parliament with unusual intensity. After years of deadlock, the bloc’s new rules on plants developed through new genomic techniques are approaching a decisive plenary vote, expected in the middle of this month following a committee stage at the start of June.
The stakes are large because the regulation rewrites a settlement that has governed European farming since the late 1990s. Under current law, a crop altered with modern gene-editing tools such as CRISPR is treated identically to a transgenic organism, saddled with the same costly authorisation, traceability and labelling demands. Breeders argue this lumps together two very different things: a plant carrying a foreign gene and one whose own DNA has been nudged to resist drought or disease in a way that could have arisen through conventional crossing.
The compromise hammered out between the Council and Parliament splits these plants into two camps. Category one covers varieties judged equivalent to conventionally bred crops; they would escape the weight of GMO legislation and, except for seeds and other reproductive material, would not need a label. Category two, reserved for plants with deeper or more unusual modifications, would stay inside the existing rulebook with its authorisation and labelling requirements intact. Crucially, plants engineered for traits such as herbicide tolerance are pushed out of the lighter category, a carve-out meant to soothe critics who fear deregulation by stealth.
The Council adopted its position in late April, but the text still has to clear a Parliament where the arithmetic is uncertain. Centre-right and liberal blocs broadly back the reform as a way to keep European plant science competitive with the United States and China, where gene-edited crops already reach farmers’ fields. Greens and much of the left warn that loosening oversight risks consumer trust, threatens organic growers who must remain free of engineered material, and hands too much power to a handful of seed companies.
That last worry has fixed attention on patents. The agreed text obliges developers of category one plants to lodge patent information in a public database, a transparency measure intended to stop farmers and smaller breeders from unknowingly infringing rights or being locked out of widely used genetic traits. Campaigners counter that disclosure alone does little to curb the consolidation of intellectual property in an industry already dominated by a few multinationals.
For the researchers in Wageningen, the vote is more than a regulatory footnote. A favourable outcome would unlock field trials and commercial pathways for crops bred to need less water, fewer chemical inputs and to withstand a warming climate, the kind of work that has accumulated in laboratories while the law stood still. A rejection, or a string of hostile amendments, would send the file back into uncertainty and, breeders fear, push the most ambitious projects to jurisdictions that decided the question long ago. Either way, a debate that has simmered for a generation is about to reach a point of no return.
