Toulouse: In the satellite assembly halls of Europe’s aerospace capital, engineers are accustomed to thinking in decades and millions of kilometres. They are now being asked to think about something closer and messier: the growing cloud of defunct rockets, dead satellites and shattered fragments that turns low Earth orbit into a shooting gallery. The European Union’s answer, the proposed EU Space Act, has entered the often-bruising machinery of the legislative process, and its progress this spring offers the first real test of whether the bloc can regulate a domain it has long left to engineers and national agencies.
The Commission tabled the act last June as a single rulebook for the safety, resilience and sustainability of space activities across the Union. Until now, Europe’s space sector has operated under a fragmented patchwork of national licensing regimes, an arrangement that looks increasingly untenable as commercial constellations of thousands of satellites crowd the skies. The proposal rests on three pillars: safety, which tackles collision risk and debris and lays the groundwork for a future system of space traffic management; resilience, which hardens satellites and ground stations against cyberattack; and sustainability, which seeks to limit the orbital litter that each new launch leaves behind.
The debris problem gives the act its urgency. Decades of launches have left orbit strewn with hundreds of thousands of trackable objects and far more that are too small to follow yet still lethal at orbital speeds. A single collision can spawn thousands of new fragments, each capable of triggering the next, a cascading hazard that physicists have warned about for years and that operators now confront in routine collision-avoidance manoeuvres. By demanding better trackability of space objects and a clear strategy for managing debris, the act tries to impose a measure of order on a commons that no one owns and everyone uses.
Turning that ambition into law is proving contentious. In March the Parliament’s rapporteur published a draft report, and the Council presidency circulated its own compromise text, revealing material divergences on several fronts. The sharpest disputes concern cybersecurity obligations, the conditions for market access, and how far the new rules should reach operators based outside the Union who nonetheless provide services within it. Non-European satellite companies have watched warily, aware that a regulation with extraterritorial bite could reshape the terms on which they do business with the continent, much as the bloc’s data and digital rules have done in other sectors.
Industry is divided. Larger European operators broadly welcome a common framework that replaces twenty-seven national rulebooks with one, reducing the cost of doing business across borders. Smaller firms and start-ups worry that heavy compliance and cybersecurity requirements could entrench the incumbents and price out the very innovators Europe hopes to nurture in a sector dominated by American and increasingly Chinese players. Striking the balance between safety and competitiveness, between writing rules and stifling the industry those rules are meant to protect, is the needle the negotiators must thread.
For all the technical disagreement, the underlying logic is hard to dispute. Space has become critical infrastructure, woven into navigation, communication, finance and defence, and an environment that grows more crowded and more contested by the year cannot be governed by goodwill alone. Whether Europe’s first attempt at a comprehensive space law emerges intact from the coming negotiations, or is watered down into a statement of intent, will signal how seriously the continent intends to defend its place above the clouds.
