Kiruna: From the spaceport on the edge of Swedish Lapland, where rockets climb into Arctic skies, the business of reaching orbit has until now been governed by a patchwork of national rules and international custom. The European Union wants to change that, and its proposed Space Act would impose the bloc’s first harmonised framework on an industry that has grown faster than the law around it.
Launched by the Commission, the draft regulation is built on three pillars. The first is safety, with rules for tracking objects, choosing orbits, avoiding collisions and disposing of satellites at the end of their working lives, a response to the swelling cloud of debris that now threatens every mission. The second is resilience, bringing tailored cybersecurity obligations to infrastructure that underpins navigation, communications and Earth observation. The third is sustainability and competitiveness, an attempt to ensure that European firms can lead in key markets rather than merely comply with rules written for them.
The ambition is a single market for space, replacing divergent national regimes with one set of requirements that applies whoever is launching and from wherever. Constellations, the large fleets of small satellites that companies are deploying in low orbit, would face additional reporting duties and obligations to share position data, reflecting the disproportionate risk that crowded shells pose to everyone else operating above the planet.
The friction is already considerable. The framework would establish a new field of EU regulation from 2030, and providers, including those based outside the bloc, would need to prepare for compliance well in advance or risk being shut out of the European market. That extraterritorial reach has drawn sharp criticism from American officials, who have characterised the proposal as complicated overreach that could burden their companies. Some member governments, too, are wary of where authority over national security assets should sit.
That last point has become a particular flashpoint. A national security clause, intended to carve out sensitive military and intelligence activity, has been attacked by legal scholars who argue it is so broad it could swallow the regulation’s safety and sustainability aims, letting states exempt large swaths of activity from the very rules meant to keep orbits usable. Strip it out, they contend, and the Act is stronger; leave it in, and enforcement becomes selective.
Industry voices are split between those who welcome legal certainty after years of improvisation and those who fear that compliance costs will fall hardest on smaller European start-ups, the very firms the Act claims to champion. Writing rules that protect the orbital commons without smothering a young sector is a delicate act, and the long runway to 2030 gives lobbyists ample time to reshape the text.
What is not in dispute is the underlying problem. Orbits are finite, debris is multiplying, and a single collision can spawn thousands of new fragments. Whether or not this particular law survives intact, the era in which space governed itself by goodwill is ending, and Europe intends to help write what comes next.
